November 2009 Newsletter

Attorney Mike Gulo was our presenter for the November meeting. The goal of financial planning for someone with a disability is to maximize and protect their government and private benefits. Guardianships are legal documents created to take care of physical, medical or educational directives. Guardianships place a person in charge, such as a parent over a disabled child, adult child over a disabled parent to establish guidance and control over life choices. A Power of Attorney for medical and financial decisions can also be put into place to help a disabled family member make appropriate choices.

Special Need Trusts are set up to shield money from the state. Monies put into a trust are only used for specific purposes not including food or shelter. Expenditures that can be used from a special needs trust, but are not limited to are utilities, vacations, entertainment, medical use, furniture, respite, therapy, insurance, electronics etc…

Pooled trusts are sometimes created when money from several special needs trusts is invested, but there is usually a payback to the government for any unused funds. When deciding to create a special needs trust for an individual, make sure the attorney is experienced in creating them. One way to know if the attorney is experienced is to ask them what a D4C Trust is. If he doesn’t know, find another attorney. A D4C Trust is another name for a pooled trust.
